Crackers ban and why I took a counter position ….!!!!
As the Diwali season comes to close lot of people who know
me, know my irritated statements regarding the crackers ban or should I say
restricted use of crackers during diwali , lot of people found my position
regressive , outlandish and illogical. Here is the reason that I busted
crackers probably after a span of 10 years and why I think it’s time to speak
up against this fake activism. Could
anyone seriously give me the logic of restrictions on crackers, what exactly
are green crackers and etc that the courts had it in its verdict as
permissible? Can anyone sight a serious study that has been done regarding the
impact of crackers on air and noise pollution…! When people talk about pro poor
majors elsewhere has anyone given a serious study about how this sudden
regulations impacted the crackers industry which is largely MSME. When I raise
this valid legitimate questions the usual feedback is I am a BJP right wing
bhakt and so on…!! How does raising valid questions be termed partisanship at
all I don’t understand or even celebrating Diwali is now associated with you
being a BJP supporter or not.
The only study thus far that I have come across, has been
done IIT Kanpur and the results of crackers on pollution are inconclusive at least or minimalistic at
best , also the noise pollution argument is futile as the recorded sound level
were well within the permissible limits. Sure it causes pollution and there is
no denying that fact , but how much does a 2 day festival hurt when the study
put CROP BURNING on which no political party is ready to comment just because
of the poor and marginalized people from agricultural sector ( major VOTE BANK)are
involved, is the real reason to ask rather than name calling. Corp burning 41 %
, industrial 21% , vehicular 19% and others which as remaining factors came out
as top polluting factors . YES crackers sadly were among the lowest in the
others list as well..!! Now that the Diwali is over and the media as expected
as gone silent on the still deteriorating Delhi air the stance of the court
seems ill thought out and lacks serious study and the stance of the media
unequivocally seems to be agenda driven.
When BJP Maharashtra chief minister Devendra Fadnavis takes
some stupid oath to not bust crackers doesn’t he come out a fool as the courts
clearly says crackers within the timings are allowed. The timings part is even more curious as people busting
crackers after 10 were jailed. I mean is it really that serious a offense to
jail people or a fine is enough. The things jus t don’t add up when you go
deeper as do you really have the police force to jail very person who busts crackers
and the results were out , as most people dissented and the police was helpless.

The even greater question to ask is whether courts should
make laws at all. The court is the guardian of the law and constitution can
outlaw it based on constitutionality, but should it venture into making laws
which is necessarily a function of legislators. After all Law of the land is
nothing but the collective conscience of the people of the land and thus isn’t
parliament the best place to make laws.!! Also you can’t deny the religious angle to
DIWALI and by meddling into traditions is court really following the secular
spirit which clearly means separation of religion and state….!!! The point I am
driving through is the change even if necessary has to be brought in via
community and change in mindset and not by court orders which are counterproductive
in democracy…!! More of this on a more serious topic were the court verdict has had serious ramifications when I try to pen down
Sabrimala issue…!!
